TORONTO – On Thursday, November 8th, 2012 at 10 am (Eastern Time) The Rocco Galati Law Firm, (Suite 203, 637 College Street, Toronto, Canada) will hold a MEDIA NEWS CONFERENCE regarding a Class Action Lawsuit that was recently filed, on the behalf of their clients, against Health Canada.

Mr. Galati (lawyer), Nick Mancuso (Actor/Consumer Advocate), Marilyn Nelson (Natural Health Freedom Canada), and David Roland (Natural Health Freedom Advocate), will field questions from the media regarding this Class Action lawsuit.

The Class Action Lawsuit maintains that:

1) Dietary supplements and vitamins (“natural health products”) are safe. In the entire 50+ history of the health food industry in Canada, these innocuous products have caused zero fatalities.

2) Consumers are sufficiently protected from possible harm and fraud with respect to these products by the Food and Drugs Act, the Competition Act, Canadian Advertising Standards, and the Criminal Code. The Natural Health Product Regulations are unnecessary in that they do not provide any additional protection to consumers.

3) The Natural Health Product Regulations and the NPN Licensing Scheme are ultra vires (unlawful) in that they contravene the Constitution Act, 1867. Health Canada does NOT have any legal authority to regulate health products, as such.

4) Health Canada has the right to restrict only those products that have been proven to have caused death or serious injury. In the absence of proven harm, dietary supplements and vitamins must be presumed to be safe (i.e., innocent until proven guilty). Health Canada has unlawfully reversed this onus, however, by insisting that suppliers prove their products “not unsafe” before being granted permission to sell them.

5) The oppressive and unlawful NHP Regulations have restricted many thousands of safe and effective products from the market, thus depriving consumers of their freedom to choose valuable health options (in apparent violation of our Charter of Rights and Freedoms).

In the Statement of Claim filed in the Federal Court of Canada, the Lawsuit claims that many of the current policies, regulations and actions undertaken or initiated by Health Canada, against Canadian natural health product manufacturers, retailers or their suppliers, are unconstitutional and contravene The Canadian Charter of Rights and Freedoms and The Canadian Constitution.

    And…PS…why did Dr Mercola have to change his article referring to the CHFA being heavily controlled by industry.

    In essence, “being the voice of the government within the industry, rather than the voice of industry to the government”? Who threatened him?

No one is agaist good manufacturing practices and proper labelling.It is the unfair mannor in which Health Canada is treating the natural health industry that has us all up in arms. NHPs are not drugs and should not be regulated as drugs. They have not killed anyone. However properly prescribed drugs have killed thousands of people.
    Go drink some of your own urine. Its good for you. Have you not heard of urine therapy?

    I think it is time that people have the freedom to choose Natural health products over pharmaceuticals as more and more folks are becoming aware of the consequences of taking prescribed drugs which have so many negative and or dangerous side effects! More and more people are becoming educated on their health and or well being and people should have the right to choose and not be dictated by some bureaucracy who are really siding with the pharmaceutical industry! It is so true that money is the source of all evil!

    It’s about time someone had the balls to go after these greedy leeches. Their pills were NEVER good for us, they only faught the symptoms not the cause. It was always all about the money. I had a friend who had arthritis and on 52 different kinds of pills and she died at the age of 32. They should have been sued. Just like marijuana fights cancer but would they tell us that? No of course not, they would rather make it illegal and sell their pills. Its right on the first page of the bible ffs. Genesis 1:29. Who are they to take our gifts away. We are all suppose to be equal period.

  10. (1) – Canadians are not as stupid as the government constantly treats us. I remember stats that showed how many people had died from prescription drug caused by errors, reactions, and side effects. None died from ingesting any natural health products. ZERO!

    (2) – It is the manufacturers of the pill that is lobbying Ottawa to kill off the right to choose health goods. Knowing who they have wined, dined, and exchanged shares in the corporation/s that fight the right to choose health care, should be investigated and published

    (3) – Remember back when the pharmaceutical companies balked at the idea of natural health products. Then they saw the value. Now they all make them, and just want to control it all. It boils down to greed, not a care for Canadians, just greed.

    SUMMARY::: The conservatives may drive over our rights, but the road they are leads to hell. Remember who NOT to votes for in the next election.

    Come on, now. We have maintain the medical monopoly! Can’t have free enterprise in the provision of health and wellness – that could get entirely out of hand – hell, if fee schedules were proscribed we might end up with cheaper doctors, dentists, and medicines. Can’t have that!

    This is very good news, Canadians are tired of having their health choices dictated by the government which is limited “to pharmaceutical drugs or surgeries”. You cannot keep a person on a mission to be healthy from getting a product they want, limiting these items to Canadian just promotes more people to then go beyond Canada’s reach ordering potentially more harmful or unsafer versions.

    Free will and free choice means being able to decide between all of the options especially the safer proactive ones which including supplementation and complimentary therapies and treatments. Great Work Mr. Nick Mancuso good to see you again.

  14. Great, if this suit is successful, I can piss in a bottle, sell it to you people as a cure for arthritis and as long as it doesn’t kill anyone it’s A-OK! Or…if I’m a pharmaceutical company all I have to do is put a different label on my dangerous drugs and I could just sell it over the counter without any pesky prescriptions. Wouldn’t that be great!

    Of course, I’m happy to hear of this challenge. These bureaucrats need to get out of regulating our lives. They don’t know or care what is best for us. I wouldn’t get too excited yet. Our governments are bought and paid for and this interference by Health Canada is all part of implementing the U.N. codex alimentarius, even as Agenda 21 is also being slowly implemented. We can only hope the court is not also corrupt.

Their bullying has been affecting all of us 1000’s of good health giving products have been removed (at gun point in some cases) whilst killer products/drugs are approved rapidly and readily.
